O R D E R
ADNAN-UL-KARIM MEMON, J. – Through
this petition, the petitioner, has mainly prayed for direction to
the competent authority of the Respondent-Company to resolve his electricity
related issue on priority basis. As per pleading of the petitioner, dispute has
arisen between them relating to installation of electricity connection as per
Demand Notice dated 13.4.2019.
2. We
have noticed that non-installation of electricity connection has been
challenged by the petitioner before this Court rather than before the competent
authority of respondent-company, who has jurisdiction to deal with the matter.
3. Learned Counsel for the
petitioner argued that the respondent-company is adamant not to install
electricity connection; besides, they failed to restrain the officials of the
company who have allowed favours to influential of the locality and deprived
the poor people of electricity, who have been paying full electricity charges
without electricity. It is also contended that the petitioner is constrained to
invoke the jurisdiction of this court as the respondents had failed to redress
his grievance despite passage of considerable time.
4. We have heard learned Counsel for the petitioner at some considerable length and perused the material available on record.
5. According to the petitioner, he was constrained to file this petition as the officials of respondent-company had failed to discharge their functions according to law. The petitioner has not been able to convince us that he has availed / exhausted his remedy in accordance with law before filing this petition. However, it may be observed that, an aggrieved person has to first avail the remedy provided to him by law before the competent authority of respondent-company and he must exhaust such remedy before approaching this Court instead of bypassing the appellate forum.
6. This petition and applications pending therein stand dismissed in limine in the above terms with no order as to costs.
