            On account of dismissal of bail application of applicants/accused Khadim and Hussain Bux for non-prosecution, the notice u/s.514 Cr.PC was issued against their surety, the reply whereof is furnished by him stating therein that the absence on part of the applicants/accused was not willful but beyond their control and they after dismissal of their first bail application for non-prosecution have again surrendered before this Court and have been admitted to pre-arrest bail. By submitting so, the surety has prayed for recalling of notice u/s.514 Cr.PC, which is issued against him. It is not opposed by learned D.P.G for the State.

                    In view of above, notice u/s.514 Cr.PC issued against the surety is recalled and vacated. Office is directed to return the surety papers/Special Saving Certificate to the surety on proper verification.
