Irshad Ali Shah J;- It is alleged that the applicant with the rest of the culprits in collusion with each other drawn and misappropriated the public money against pensionary benefits of alleged retired employees of Education department, by preparing fake Accounts, for that the present case was registered.
2. The applicant on having been refused post arrest bail by learned Special Judge, Anti Corruption (Provincial) Larkana, has sought for the same from this Court by way of instant application u/s 497 Cr.P.C.
3. It is contended by learned counsel for the applicant that he being innocent has been involved in this case falsely by the police; the FIR has been lodged with the delay of about one year and co-accused hafiz Abdul Shakoor and five others, have already been admitted to bail by this Court. By contending so, he sought for post arrest bail for the applicant on point of further enquiry and consistency.
4. Learned D.P.G. for the State has recorded no objection to release of the applicant on bail.
5. I have considered the above arguments and perused the record.
6. The FIR of the incident has been lodged with the delay of about one year; the name of applicant is not appearing in FIR; the offence alleged is not falling within prohibitory clause of section 497 Cr.P.C; the case is based on documentary evidence which has already been collected by the police; case has finally been challaned and co-accused hafiz Abdul Shakoor and five others have already been admitted to bail by this Court. In these circumstances, the applicant is found entitled to be released on bail on the point of consistency and further inquiry.
7. In view of above, the applicant is admitted to post arrest bail subject to his furnishing solvent surety in the sum of Rs. 500,000/- (Rupees Five Lac) and PR bond in the like amount to the satisfaction of learned trial court.
8. The instant bail application is disposed of accordingly.
