This petition was
filed by the petitioner who subsequently expired. He retired from service
of Pakistan Railways in the year 2004. Then as a third party a rent agreement
was executed on 30.09.2010 and he was paying rent on commercial rent basis in
terms of the policy in vogue at the relevant time. He, apparently surrendered
all rights available to a retired employee, when rent agreement on commercial
basis was executed and hence any such right as being of a retired employee and
then after his sad demise, as he stated now, any of such right cannot be passed
on to the legal heirs. Be that as it may, such request for extension of renting
out such subject quarter as already been rejected by the Managing Director /
CSF Lahore vide decision dated 10.06.2013. In case any indulgence is required
for the widow of the petitioner that shall be dealt with and considered within
one (01) week from today. The legal heirs of the petitioner are not required to
be issued any notice as the counsel is also stated to have been authorized by
them. They may pursue such application on their own, however, Pakistan Railways
shall decide such application, if it is pending, within one (01) week.
The petition as
such is dismissed along with listed
applications.
