Learned counsel for the applicant amongst other, has raised several grounds, however, ultimately he resorted to the provision of section 28 of Anti-Terrorism Act, 1997, whereby he has agitated the safety and convenience of the witnesses. He has requested that to the choice of respondents’ counsel, the case may be transferred from the present Court of District Naushahro Feroze to any other Court. Mr. Athar Abbas Solangi, though has serious objections to the maintainability of this transfer application, has shown his grace for the transfer of this case to any of the two courts of District Sukkur. Presently, there are two courts under the Anti-Terrorism Act, 1997. Though the ground raised by the applicant / complainant regarding lack of confidence over the Presiding Officer has not been established or made out, however, for the sake of convenience and safety of the witnesses in a triple murder case, I am inclined and of course with the consent of respondents’ counsel transfer the case from the Court of Anti-Terrorism, District Naushahro Feroze to Court No.1 Anti-Terrorism, District Sukkur. The transferee Court, however, is directed to expedite the proceedings.

Transfer application stands disposed of.
