                        The applicant by way of instant application u/s 497 (5) Cr.PC has sought for cancellation of bail which is granted to the private respondent by learned trial Court, on medical ground, on the basis of medical certificate issued by a Physician, Civil Hospital, Jacobabad, the same according to applicant is false and managed.  

                        It is stated by learned counsel for the applicant that in first instance he would seek cancellation of bail of the private respondent by filing such application before learned trial Court. By stating so, he does not press the instant application.

                        In view of above, the instant application is disposed of as not pressed with direction to learned trial Court that if an application for cancellation of bail of private respondent is filed, then it should be disposed of after calling for opinion of the medical board with regard to health condition of the private respondent.
