Report dated 23.10.2017 is presented
which is taken on record which shows that the petitioner is residing in the
separate location away from the one in
which she was residing before. It is submitted by the counsel for the
petitioner that the earlier accommodation was provided to the husband of the
petitioner by her father-in-law through Iqrarnama. Copy of Iqrarnama dated
29.1.2000 is on file which provides that the father-in-law of the petitioner
had handed over possession of his place among his four sons . It is a matter of
record that on ground of certain disputes, father in law had relinquished
husband of the petitioner through AAQNAMA whereafter separate accommodation was
arranged by him in which the petitioner is now residing along with her
children.
This petition was
originally filed seeking protection alleging harassment from private
respondents and this Court vide dated order 18.11.2015 directed police that no
harassment be caused to the petitioner and legal protection be provided to her.
This petition has now been used as a tool in the battle of property claims
which was neither the intent of the instant petition, nor such an objective
through this petition could be achieved. If the petitioner has any right,title
or interest in any family property, the same must be pressed/adjudgedthrough
the competent forum. The petition is accordingly disposed of with direction to
the parties to not to harass each other and adopt legal course available to
them for settlement of their civil disputes. Area police is directed to stand
neutral and not to harass the parties.
