Petitioner states that he has got constructed a protective Bund from his own funds for protecting his lands from rain water, however, surprisingly he received show cause notice annexed at Page 21 wherein Assistant Commissioner/Chairman Sub-Divisional Disaster Management Authority has called upon the petitioner for initiating action under article 33(b) of PDMA Ordinance. It is stated by the petitioner as well as counsel for the petitioner that this is a private Bund built by the petitioner on his own land thus not governed by any regulations,thus not government by PDMA.

It is thus apparent the show cause notice issued by respondent No.3 to the petitioner is without jurisdiction. In the given circumstances, officer present in person undertakes to immediately withdraw the said show cause notice and to ensure that no harassment be caused to the petitioner in this regard.

The petition stands disposed of in the above terms.
