Despite this Court’s order, respondent No.3 is called absent. Learned Assistant A.G seeks time in this regard. The case at hand is about the fate of an application moved by the petitioner under section 18 of the Land Acquisition Act1894 to the Assistant Commissioner & Land Acquisition Officer Sukkur which is said to have been received on 17.06.1999.Since the said officer did not pass any order thereon,the instant petition has been filed in the year 2015. Comments have been filed by respondent No.3, who in paragraph No.5 of his comments denies the existence of such application. Time had been given to the respondent No.3 to appear in person, bring all the record and satisfy this Court, which seemingly has not been done.

In the given circumstances respondent No.3 is directed to entertain the application of the petitioner, pass appropriate order in compliance of section 18 of the Land Acquisition Act, 1894 and place reference in this regard before the District Court Sukkur within three weeks. With this order the instant petition is disposed of.
