2.                     The applicants by way of instant application u/s.561-A Cr.PC have impugned an order dated 09.04.2018, passed by learned Civil Judge & Judicial Magistrate, Thull, whereby he has declined to make disposal of the case outcome of FIR Crime No.18/2018, u/s.337-A(ii),F(i) & (v), 504, 114, 147,149 PPC of P.S Thull, under “B” class.

                        At the very outset, it is stated by learned counsel for the applicants that he would not press disposal of instant application on merits, if the applicants are permitted to seek their premature acquittal by way of filing an application u/s.249-A Cr.PC and/or 265-K Cr.PC as the case may be before learned trial Court.

                        Learned A.P.G did not oppose to above said proposal.

                        In view of above, the instant application u/s.561-A Cr.PC is dismissed as not pressed, with permission to the applicants to seek their premature acquittal from the learned trial Court by way of filing an application u/s.249-A Cr.PC and/or 265-K Cr.PC, as the case may be, the same on filing would be decided by learned trial Court within 30 days, strictly on its merits.
