           It is stated by the learned counsel for the applicant that the applicant has not been heard by the learned trial Court before passing of impugned order under section 514 Cr.PC, which is against the spirit of law, as none is to be condemned unheard. By contending so, he sought for remand of the matter to learned trial Court for passing afresh order after providing an opportunity of hearing to the applicant.

          Learned A.P.G recorded no objection to remand of the case.

          In view of above, the impugned order is set-aside and the matter is remanded to learned trial Court with directions to pass afresh order under section 514 Cr.PC, after providing an opportunity of hearing to the applicant.

          The instant criminal miscellaneous application is disposed of in above terms with direction to the applicant/surety to appear before the trial Court on 10.10.2018.
