A brief is held for the counsel for the plaintiff who is reported to be busy before another Bench. Mr. Rana draws Court’s attention to order dated 25.10.2012 as well as 08.11.2012 and 14.11.2012 in terms whereof plaintiff was directed to satisfy as to the maintainability of the suit. Through this Court’s order dated 20.08.2018 it was observed that if plaintiff is not present on the date given (i.e. today), the application be heard and decided on the basis of the record available on file.

Learned counsel for defendant No.1 has filed a statement, taken on record, copy supplied and received by counsel holding brief for plaintiff’s counsel which suggests that in fact plaintiff association has since been dissolved after following the codel formalities.

In the given circumstances when despite giving repeated opportunities, plaintiff has not been able to satisfy the very fundamental questions as to the maintainability and even today none is present on behalf of the plaintiff, as mandated by the earlier order, the applications are accordingly dismissed.
