Learned counsel for defendants who has filed a counter to the instant application submits that the instant application be allowed as none of the parties is interested in creating third party interest in the suit property. Accordingly the application is allowed by restraining the parties from alienating or creating any charge or encumbrances on the or third party interest in suit property i.e. piece and parcel of land bearing Survey No.6, Sheet No.SB-7, with Shop No.9 at Ground Floor and three stories office building at upper floors, situated on Saddar Bazar Quarters, Zaibunnisa Street, Saddar, Karachi.

Having decided the said application, the matter now be fixed for framing of issues.

At this juncture learned counsel for defendants submits that defendant No.16 Amber Sohail has since expired, she intends to file list of legal heirs for that defendant. She is allowed to do so whereafter the plaintiff to file amended title. Once the amended title is filed, office is directed to issue notices to newly added legal heirs of defendant No.16.
