Counsel jointly state that parties have settled that if the plaintiff does not press the damages, the suit may be disposed of on the statement of the defendant that they neither used designs of plaintiff related to textile goods in the past nor would do so in the future. This statement coming from the defendant’s counsel and the plaintiff not pressing his claim for damages, now effectually brings the controversy to an end. The instant suit is disposed of accordingly with mutual consent with no orders as to costs.
