Mr. Liaquat Hussain has affected appearance on behalf of defendant No.1 pursuant to this Court’s order dated 07.08.2018. He raises no objection to the return of surety amount alongwith interest accrued thereon to the plaintiff. Counsel for the plaintiff reiterated the fact that a sum of Rs.3,55,00,000/- was deposited by the plaintiff in the shape of Special Saving Certificates in compliance of this Court’s order dated 01.02.2013 which was invested in interest bearing security and until the last report from the Nazir had matured to the tune of Rs.4,60,63,500/-. He states that plaintiff intends to withdraw the said amount since the suit was dismissed as withdrawn. Today when no objection has come from the defendants’ side and Nazir has already affirmed availability of this amount, let the surety amount alongwith interest accrued thereon be returned to the plaintiff after proper verification and following the prescribed procedure.

Application stands disposed of in the above terms.
