None is present from either side, which has been the case for the last many years. On the last date of hearing the directions were given for the issuance of notice to the plaintiff. The Bailiff report suggests that an attempt was made, however at the given address the plaintiff was not even found residing. In one of the earlier dates, Vakalatnama was also withdrawn by the counsel for the plaintiff. In the circumstances at hand, where there appears to be no real possibility of progressing with the case, which has remained unattended by the plaintiff for years, suit is thus dismissed on account of non-prosecution along with pending applications.
