            Applicant/accused Attar Khan son of Habibullah seeks protective bail in F.I.R. No.169/2019, registered at P.S. Peerabad, Karachi West under sections 302, 324, 34, PPC read with section 7 of the Anti-Terrorism Act, 1997.

 

            It appears that protective bail was granted to the applicant/accused by this Court vide order dated 16.07.2019 for three days with direction to surrender before learned Judge Anti-Terrorism Court-II, Karachi in the aforesaid period and to join the investigation. Counsel for the applicant/accused submits that the applicant/accused surrendered before the learned Judge, Anti-Terrorism Court-II, Karachi within the stipulated period but it appears from the order dated 18.07.2019 that accused and his counsel were called absent and pre-arrest bail was dismissed on account of non-prosecution.

 

            In the peculiar circumstances, protective bail for a period of four (4) days from today is granted to applicant/accused Attar Khan son of Habibullah, subject to furnishing solvent surety in the sum of Rs.100,000/- (Rupees one hundred thousand) and P.R. bond in the like amount to the satisfaction of the Nazir of this Court. Applicant/accused is directed to surrender before the learned Judge, Anti-Terrorism Court-II, Karachi, in the aforesaid period. This order shall cease to have its effect after expiry of four days from today or whenever the applicant/accused surrenders before the trial Court, which one occurs earlier. However, it is made clear in case applicant/accused fails to surrender before the trial court in the aforesaid period, his bail bond shall stand forfeited.    

 

            Application is accordingly disposed of.
