This criminal transfer application
is called for hearing. Applicant Ghulam Yaseen son of Muhammad Ali Bhatti is
present submits that today this matter may be adjourned to some other date as
his counsel could not reach. No reason has been pointed out / explained by the
applicant why his advocate could not reach to this Court.
Since the advocate is absent and
this case pertains to Anti-Terrorism Court where case is to be decided as early
as possible as per law. This criminal transfer application has been filed on
26.11.2018, almost seven months has been passed and the trial stands stopped
due to pendency of this transfer application.
Applicant present in Court submits
that he had filed transfer application against Mr. Shakeel Hyder Shah the Judge
of Anti-Terrorism Court-I Sukkur on the ground that the applicant has lost
faith upon the Presiding Officer.
Learned Additional P.G submits that
Mr. Shakeel Hyder stands transferred and in place Mr. Anand Ram has taken over
the charge of the said Court.
Since the allegations in this
transfer application are against Mr. Shakeel Hyder who has already been
transferred, therefore, this transfer application under the present facts and
circumstances has become infructuous and is liable to be disposed of. The
applicant present in Court submits that he would be satisfied if the Presiding
Officer of the trial Court is directed
to proceed the case expeditiously and decide the same as early as possible
under the law.
In view of above, this transfer
application stands disposed of in the above terms. However, the learned
Presiding Officer of the trial Court is directed to decide the case as per law
in transparent manner. Office is directed to immediately send the copy of this
order to the Presiding Officer of the trial court for information and
compliance.
