            Applicant/accused Saeed Khan son of Gul Majee and Shoukat Ali Tabassum alias Rana son of Farzand Ali seek protective bail in Crime No.234/2018, registered at P.S. SITE ‘A’, Karachi, for offences under sections 365-A, 34, PPC. It is submits that after usual investigation, challan has been submitted before learned Judge, Anti-Terrorism Court-XII, Karachi, the trial Court ordered for adding the names of the applicants/accused as accused. It is stated that NBWs have been issued against the applicants/accused. Serious mala fides on the part of police and complainant have been alleged. Lastly, it is contended that applicants/accused are prepared to surrender before the trial Court but apprehend their arrest with ulterior motive at the hands of police on the way to the trial Court as NBWs have been issued against them.

 

            Without touching the merits of the case, protective bail for a period of three (3) days from today is granted to applicants/accused Saeed Khan son of Gul Majee and Shoukat Ali Tabassum alias Rana son of Farzand Ali, subject to their furnishing solvent surety in the sum of Rs.60,000/- (Rupees Sixty thousand) each and P.R. bond in the like amount to the satisfaction of the Nazir of this Court. Operation of NWBs issued against the applicants/accused is suspended for 03 days. Applicants/accused are directed to surrender before the trial Court in the aforesaid crime. This order shall cease to have its effect after expiry of three (3) days from today or whenever the applicants/accused surrender before the trial Court, which one occurs earlier. It is made clear that in case applicants/accused failed to surrender before the trial Court within the aforesaid period their bail bond shall stand forfeited.  

 

            Application is accordingly disposed of.
