Applicant/accused Rajab Ali son of Qambar Ali seeks protective bail in F.I.R. No.381/2019,
registered at P.S. Shah Latif Town, Malir, Karachi under sections 353,
324, 186, 427, PPC read with section 7 of the Anti-Terrorism Act, 1997.
It is inter alia contended that
applicant/accused is prepared to surrender before the trial court but apprehends
his arrest at the hands of the police for mala fide reasons. It is also argued
that in fact there is dispute over the plot in between the private individuals.
Serious mala fides on the part of the complainant and police have been alleged.
Without touching the merits of the
case, protective bail for a period of four (4) days from today is granted to
applicant/accused Rajab Ali son of Qambar Ali, subject
to furnishing solvent surety in the sum of Rs.40,000/- (Rupees Forty Thousand)
and P.R. bond in the like amount to the satisfaction of the Nazir of this
Court. Applicant/accused is directed to surrender before the learned Judge,
Anti-Terrorism Court-II, Karachi, in the aforesaid period. This order shall
cease to have its effect after expiry of four days from today or whenever the
applicant/accused surrenders before the trial Court, which one occurs earlier.
Application
is accordingly disposed of.
