It is stated by the applicant in his application, which he has sent from the jail on account of failure of the prosecution to produce his witnesses, the case against him has been kept in abeyance and he has been order to be released subject to furnishing surety, which he has failed to furnish. By stating so, he sought for direction against learned trial Court to expedite disposal of his case in accordance with law.

2. It is stated by learned trial Judge in his report that applicant on furnishing his surety has been released.

3. With the release of the applicant the purpose of filing the instant application has been served and it is disposed of according.
