Irshad Ali Shah, J; The applicants by way of instant Criminal Miscellaneous Application under Section 561-A Cr. P. C, have sought for quashment of proceedings of the case outcome of FIR Crime No.162/2018 under section 489-F and 506/2 PPC of Police Station Naushahro Feroze.

2. At the very outset, learned counsel for the applicants does not press the instant Criminal Miscellaneous Application in respect of applicant Muneer Hussain, as he according to him has been acquitted by learned trial Court. By stating so, he sought for quashment of the proceedings of the case against applicant Iqrar Hussain as according to him he has got good case than that of applicant Muneer Hussain.

3. Learned DPG for the State and learned counsel for the complainant have sought for dismissal of the instant application in respect of the applicant Iqrar Ahmed too by contending that he is fugitive from law.

4. I have considered the arguments and perused the record.

5. If for the sake of arguments, it is believed that applicant Muneer Hussain has already been acquitted by learned trial Court then subject to law and merits of the case, it may be a good reason for acquittal of applicant Iqrar Hussain. In that situation, it would be better for applicant Iqrar Hussain to surrender before learned trial Court and then to seek his acquittal in accordance with law by making an application u/s 249-A Cr.P.C, if so is advised to him.

6. Instant Criminal Miscellaneous Application is disposed of accordingly.
