Irshad Ali Shah, J; The facts in brief necessary for disposal of instant Criminal Miscellaneous Application under Section 561-A Cr. P. C, are that the applicant lodged an FIR with PS ‘C’ Section Sukkur for an offence punishable under Section 324, 34 PPC. On investigation, it was recommended by the police to be disposed of under ‘A’ class by furnishing such report before learned 1^st Civil Judge and Judicial Magistrate, Sukkur, who vide his order dated 20.06.2016 disposed of the said FIR under ‘B’ class.

The applicant being aggrieved of the disposal of his FIR under ‘B’ class by way of above said order, has impugned the same before this Court through instant Criminal Miscellaneous Application.

At the very outset, it is contended by learned counsel for applicant that he would not press the disposal of instant Criminal Misc. Application on merits if the disposal of the FIR of the applicant under ‘B’ class is converted into ‘A’ class.

Learned APG for the State and learned Counsel for the private respondents recorded no objection to the above said proposal.

In view of above, the disposal of the FIR of the applicant is converted from ‘B’ to ‘A’ class.

Instant Criminal Miscellaneous Application stands disposed of accordingly.
