Accused/applicants Rab Nawaz, Hazoor
Bux and Qabool Ahmed were
admitted to interim pre-arrest bail by this Court vide order dated 24.11.2017.
Subsequently, such order was recalled by this Court vide order dated 27.07.2018
by making an observation that they have misused the concession of interim
pre-arrest bail and then their surety /applicant was directed to furnish his
reply to notice under Section 514 Cr.P.C. which he
furnished by inter alia stating therein that he executed the bail bond for the
above said accused for no monetary benefits.
It is contended by the
learned counsel for the applicant/surety that the applicant/surety has executed
bail bond on behalf of the said accused on humanitarian ground and for no
monetary gain. By contending so, he sought for taking lenient action against
the applicant/surety.
It is contended by
learned DPG for the State that the said
accused are still absconding, as such, according to him, no case for lenient
action against the applicant/surety is made out.
I have considered the
arguments and perused the record.
There is no denial to
the fact that the interim pre-arrest bail which was granted to said accused was
recalled by this Court when it was found to have been misused by them. They are
still absconding, nothing has been brought on record by the applicant /surety which may indicate that he executed bail bond on behalf of
the said accused on humanitarian ground and without any monetary gain. No case
for taking lenient action is made out, consequently office is directed to encash the surety bonds and then to deposit the same with Government treasury under relevant head of account.
Order accordingly.
