Irshad Ali Shah, J;- The applicants by way of instant Criminal Transfer Application u/s 526 Cr.P.C have sought for transfer of their case from the Court of learned Additional Sessions Judge (Hudood) Sukkur to any of the Court of competent jurisdiction for its trial in accordance with law.

2. On being asked from the applicants by the Court as to why they are seeking for transfer of their case from the Court of learned Additional Sessions Judge (Hudood) Sukkur to any other Court of competent jurisdiction at Sukkur? It was stated by them that they have heard that the private respondent has win over the sympathies of learned Presiding Officer of the same Court for favourable decision.

3. The ground for which the applicants have sought for transfer of their case in face of it is appearing to be false. It is not appealing to common sense that a person, who if is able to win the sympathies of learned Presiding Officer would made it public especially to his opponent. No case could be ordered to be transferred from one Court to other on the basis of false and baseless allegation against the learned Presiding Officer of the Court.

4. In view of above, instant Criminal Transfer Application is dismissed with note of cautious to the applicants.
