Learned counsel for the applicants submits that
he is only aggrieved of a part of orders of trial Court and the appellate Court
whereby adverse findings were given while dismissing the suit and maintaining
the order of the trial Court. He defended the suit. The suit was dismissed and so
also the appeal, however, while disposing of the appeal, it was maintained by
the appellate Court that it was Government land. When enquired as to whether
any title was filed before the trial Court and appellate Court, he claims that
there were Revenue entries. Though the Revenue entries alone would not
establish a title, however, in case the applicant is interested in establishing
the title independently, he may pursue his remedy by approaching the
appropriate forum which may include civil Court for establishing his title. In
case he does and files a suit for establishing his title, the matter may be
heard and decided on merits and any observation may not come in the way in case
he is able to establish his title independently.
This Revision Application stands disposed of
in the above terms.
