Learned counsel for the petitioner has filed copy of notification of Land Utilization Department claiming his muhag rights over the land. This is a Constitution Petition under Article 199 of the Constitution of Islamic Republic of Pakistan, 1973 and such disputed questions entitling him to have this property under muhag rights cannot be adjudicated. At best, he could avail such remedy from a civil Court or any other forum having jurisdiction in this regard. He is at liberty to avail such remedy from the forum. This petition as such is not maintainable and is dismissed along with listed application.
