The ward is living with maternal grandmother. While the Criminal Miscellaneous Application was pending, the mother expired. Under no state of imagination the custody with maternal grandmother could be considered improper or illegal. In case petitioner feels that welfare does not lie while being with maternal grandmother, he may pursue his remedy before forum having jurisdiction. At the conclusion of the arguments, learned counsel submits that he would avail his remedy and, as such, on instructions does not press this petition which is, as such, dismissed as not pressed along with listed application.
