                    The applicants filed a suit for Declaration, Cancellation and Permanent Injunction before learned 2^nd Senior civil Judge, Shikarpur, the plaint whereof was rejected by learned 2^nd Senior Civil Judge, Shikarpur, at the instance of private respondents vide his order dated 20.04.2017, such rejection of their plaint was impugned by the applicants by way of filing an appeal, it was dismissed by learned 5^th Additional District Judge, Shikarpur, such dismissal of their appeal is impugned by the applicants before this Court by way of filing the instant civil revision application.  

                   At the very outset, it is stated by learned counsel for the applicants that he would not press the disposal of instant civil revision application on merits, if the applicants subject to law, are permitted to file a fresh suit before the learned trial Court.

                   The suggestion advanced by learned counsel for the applicants is not opposed by learned counsel for the private respondents and learned State Counsel.

                   In view of above, the instant civil revision application is dismissed as not pressed with permission to the applicants to file a fresh suit before learned trial Court, subject to law. No order as to costs.
