                        The applicants on trial was found to be guilty for offence punishable under Article 3/4 Prohibition (Enforcement of Hadd) Ordinance 1979 and were accordingly convicted and sentenced to undergo R.I for one year and to pay fine of Rs.10,000/- each, in case of failure to make payment of fine, they were ordered to undergo S.I for three months by learned 3rd Civil Judge and Judicial Magistrate, Mehar. The applicants preferred an appeal, it was dismissed by learned 1st Additional Sessions Judge, Mehar and they now have filed the instant criminal revision application before this Court against dismissal of their appeal.

                        As per Article 203-DD of the Constitution of Islamic Republic of Pakistan, the revisional jurisdiction in case like the present one lies with Honourable Federal Shariat Court, therefore, the learned counsel for the applicants was called upon to satisfy the maintainability of the instant criminal revision application before this Court.

                        At the very outset, the learned counsel for the applicants was fair enough to state that he would not be press the disposal of the instant criminal revision application before this Court on merit, if the applicants are permitted to exhaust their remedy before the Honourable Federal Shariat Court. Order accordingly.

                        The instant revision application is disposed of accordingly.
