Today statement
has been filed by petitioners and respondents. Both the petitioners have submitted
an apology letter to the administration of respondent University (Shah Abdul
Lateef University) Khairpur as well as a further Undertaking today before this Court,
that they will abide by the Rules and Regulations of the University, while
expressing their remorse for the past behavior which resulted in disciplinary
action against them.
On the
other hand Director Students Affairs / respondent No.5 has also filed statement
that they have lifted ban on the entry of above petitioners, while restoring
their earlier hostel facility.
In view
of the above Statement and Undertaking, this petition has served its purpose
and is accordingly disposed of with observation and direction that all the
parties must adhere to the University Code, interalia, rules and regulations.

In view
of the order passed on the last date of hearing and the statement filed by
respondent No.2 / Inspector General of Prisons Sindh Karachi through learned Additional
Advocate General Sindh, controversy has further been narrowed down and the
instant petition is disposed of by consent on the following terms.
1. The respondents in particular respondent
No.2 will consider the case of petitioner on top priority in Police Department,
when fresh recruitment is done, which is likely to start in near future but not
later than 15.11.2018. However, if for any reason the fresh recruitment
is not done by the above date then present petitioner will get the employment
in the Police department.
2. During
the proceedings it has also come on record that candidates/ applicants are
handed over their respective medical reports by the designated Medical Officers
to be submitted with the respondent No.2. It is stated by the respondents that
this procedure is part of the recruitment policy. Ex facie this is a faulty procedure. The medical fitness report
should not be handed over to any candidate / applicant, but it should be
transmitted from the concerned medical officer to the Police department
directly, for various administrative reasons, including, to make the entire
process foolproof. Accordingly respondent No.2 should make the necessary amendment
in their rule, if any, as well as procedure and practice, in view of the above
observation.
In the
above terms instant petition stands disposed of.

Through
present petition it has been averred that private respondents Nos. 5 to 11 are
causing harassment to the petitioner and she and her family members should be
provided protection.
Today
statement has been filed by Mr. Hadi Bakhsh Bhatt learned counsel for
respondent No.6 along with F.I.R to argue that firstly no harassment was caused
to the petitioner and her family rather F.I.R No.71/2017 under sections 302,311,34
PPC 7 Anti- Terrorism Act, 1997 has been registered against the husband of
petitioner and other near relatives. The above crime relates to multiple
murders including the niece of respondent No.6. Per learned counsel for the respondent
the matter is being tried by the concerned trial Court and this petition is a counter
blast.
Without
touching upon the merits of the present petition, since it has been stated by
counsel for respondent No.6 that no harassment is caused by him and copy of the
F.I.R in the above crime has also been annexed with his statements, this
petition is disposed of in the above terms that no harassment will be caused to
the petitioner. However, it is clarified that police/official respondents will act
within the parameters of law without being influenced by any observation made
in the present matter.

primarily the matter between petitioners and private respondents relates to
landed property which due to some dispute has resulted in multifarious
litigation. A judgment of learned trial Court is also forms part of the record,
passed in a criminal trial.
This
petition is disposed of with direction to respondent No.2/S.S.P District Ghotki
at Mirpur Mathelo to ensure that no law and order situation occurs due to
dispute between petitioners and private respondents by issuing necessary
protection directions, to the concerned Police Station and by further ensuring
that police to act fairly and diligently, without showing any element of
inclination towards any party. Similarly if there is a dispute pertaining to
landed property, the petitioner has a remedy to approach Court of competent
jurisdiction.

this petition petitioner is seeking direction that police officials be directed
to provide protection to the petitioner as petitioner’s former husband
(respondent No.5) Wahid Bakhsh is continuously causing harassment to the
petitioner even after passing of decree for dissolution of marriage. Copy of
the said decree is not appended with this petition, but counsel for the
petitioner makes a statement at bar to this effect.
In view
of the above, this petition is disposed of with direction that concerned Police
Station to provide adequate protection to the petitioner and take action as
required under the law.
