This is a Cr. Transfer application filed by the applicants for transfer of Cr. Case No.26 of 2017 Re: The State vs. Faqeer Jamaluddin and others from the court of II-Civil Judge/ J. M Rohri to any other competent court available at Rohri on the ground that applicants/accused have lost their trust on the Presiding Officer.

Learned counsel for the applicants/accused submits that the applicants have no confidence on learned trial Judge and prays for transfer of the case to any other competent court. Learned DPG states that there is no cogent reason for transfer of this case and application being meritless be dismissed.

Heard learned counsel for the applicants/accused, learned DPG as well as perused the comments filed by learned trial Judge in terms of the order dated 19.6.2018, which reveals that learned trial court after framing of the charge called PWs and their in chief statements have been recorded but learned counsel for accused failed to cross examine the witnesses and moved adjournment application. At this juncture on reply to the query of this Court, learned counsel for applicants submits that after filing of this transfer application adjournments were sought on the ground of pendency of this transfer application and prior to this no adjournment was sought by the counsel for applicants/accused.

I do not appreciate the tendency of litigants to get the Judge of their choice. Transfer of the case only on the ground that they lost their confidence on trial Judge without any cogent reason is no ground for transfer of case. From perusal of report/comments it reflects that learned counsel for applicants is avoiding to proceed with the matter, therefore application being meritless is dismissed.
