Through the instant application appellant seeks suspension of his sentence awarded vide judgment dated 11.01.2018 passed by learned Sessions/Special Judge CNS Thatta in Special Case No. 33 of 2016.
Learned counsel for the appellant contended that the sentence awarded to the appellant is short one and hearing of appeal may take some time. Learned counsel for the appellant by relying upon the case reported in PLD 2014 SC 241 prayed that appellant may be enlarged on bail by suspending the sentence.
Learned Additional Prosecutor General could not controvert the above submissions of learned counsel for the appellant and relied upon the case reported in 1999 SCMR 2589.
Heard the arguments and perused the record including the case law relied upon by the counsel for appellant.
Admittedly, the sentence awarded to appellant is short one and instant appeal would definitely take more time due to heavy backlog of the cases. In view of facts, circumstances and case law relied upon by the counsel for appellant, the sentence awarded to appellant is suspended and appellant is enlarged on bail subject to his furnishing surety in the sum of Rs.1,00,000/- (Rupees one lac only) and P.R.Bond in the like amount to the satisfaction of the Nazir of this Court. The listed application i.e. M.A.No.766/2018 stands disposed of in the above terms.
