In terms of order dated 02.04.2018, learned counsel for the applicant files certified copies of case diaries of trial court as well as order of transfer of case from IIIrd Additional Sessions Judge Karachi-East to IInd Additional Sessions Judge Karachi-East which are taken on the record.
Learned counsel contended that earlier vide order dated 15.01.2016 the applicant had granted bail by the IIIrd Additional Sessions Judge, Karachi-East in Crime No. 7 of 2016 under section 353/324/34 PPC registered with Police Station Gulistan-e-Jauhar, Karachi and was attending the Court regularly but on transfer of the case to the Anti-Terrorism Court & IInd Additional Sessions Judge, Karachi-East, the earlier bail was dismissed and trial court had issued NBWs against the applicant. Learned counsel next submits that the applicant intends to surrender before the concerned court but due to issuance of NBWs against him, having apprehension of maltreatment, disgrace, humiliation from the hands of investigating agency, if arrested, he has approached this Court for grant of protection and suspension of NBWs issued against him by the trial court.
Be that as it may, without adverting to the merits of the case, by suspending the operation of NBWs issued against the applicant, protective bail for seven days from today is granted to the applicant on his furnishing solvent surety in the sum of Rs.1,00,000/- (Rupees one lac only) and P.R.Bond in the like amount to the satisfaction of the Nazir of this Court.
This concession of protective bail shall cease to have force on 15.04.2018 or when the applicant surrenders himself before the concerned court, whichever is earlier.
This bail application stands disposed of in the above terms.
