It is stated by the learned counsel for applicant that he was not heard by learned trial magistrate and he would be satisfied, if impugned order is set-aside and directions may be issued to the learned trial magistrate that after hearing him, decide the report of police in accordance with law.

Learned counsel for private respondents has recorded no objection.

In view of the above, impugned order is set-aside. Learned trial magistrate is directed to hear counsel for both parties, and decide the report of police in accordance with law. Both parties are directed to appear before the learned trial magistrate on 14.04.2018.

Instant miscellaneous application is disposed of in above terms.
