Comments have been filed by official respondents No.2, 3 and 5, which are taken on record.

Mr. Zahid Hussain Rajput advocate files power on behalf of respondents 6 & 7 as well as certified copy of order passed on 24.05.2017 by a learned Division Bench of this Court in C.P No.D-1400 / 2017 filed by Mst. Uzma and Rabnawaz against the present petitioner and three official respondents. Perusal of the aforesaid order shows that the above petition was filed by Mst. Uzma / alleged detainee as she was being harassed by her father Abdul Karim (the present petitioner) because she has contracted marriage with Rabnawaz with her own free will. The present petitioner has lodged FIR No.32 / 2017 under section 365-B read with section 34 PPC against Rabnawaz. It is stated by Mst.Uzma in her above petition that she is sui juris, she had contracted marriage with own free will and she is living with Rabnawaz with her own choice. The above mentioned petition is fixed on 15.06.2017 wherein notices have been ordered to be issued.

In the present petition, the petitioner has alleged that Mst. Uzma is in wrongful confinement of private respondents. In view of the stance taken by Mst. Uzma in her above mentioned petition, the allegation of wrongful confinement, prima facie, appears to be incorrect. If the petitioner has any grievance, he may contest the above petition filed by his daughter Mst. Uzma. In my opinion no order can be passed in the present petition in above circumstances. Accordingly, the petition stands disposed of with no order as to costs.
