Through the instant Constitution
Petition petitioner Javed s/o Shahnawaz
has prayed for the following reliefs:-
a). That this Honourable Court may be
pleased to direct the respondents No.4 and 5 not to cause any kind of
harassment to the petitioner his brothers and other Family members at the
instance of respondent No.6 to 8 through themselves, their assignees,
subordinates, servants, successors, friends or agent or through any other
agency in any manner.
b). That this Honourable Court may be
pleased to direct the respondent No.2 SSP Sanghar to provide protection
to the petitioner his brother & their family members enabling them to pass
his regular life without any fear, force and compulsion.
c). That this Honourable Court may be
pleased to pass an order to conduct Judicial Inquiry through District &
Sessions Judge Sanghar in Crime No.32
of 2016 of Police Station Tando Adam city district Sanghar
U/s 395, 342, 337-H(ii), 504, 506(2) PPC.
d). That, this Honourable Court may be
pleased to direct the respondents NO.3, 4 not to register the FIR / Criminal
case against the petitioners and their family members without prior permission
of this Honourable Court.
e). That, this Honourable Court may be
pleased to direct the respondent No.2 DIG Shaheed Benazirabad to take
necessary department action against SHO P.S. Tando
Adam City for misusing his official power and position and committing excess upon
petitioner, his brothers and other family members under intimation to this
Honourable Court.
Notices were issued against the
Respondents as well as A.A.G. Mr. Shafique Ahmed
Shah, Advocate file Power on behalf of the respondents No.6 to 8 and undertakes
that no harassment whatsoever shall be caused by the private respondents to the
petitioner. As regards to the dispute over the agricultural land counsel for
the respondents No.6 to 8 states that the same shall be adjudicated by the
competent court of law.
Learned A.A.G. submits that he has
already filed parawise comments on behalf of official
respondents in which they have denied allegation of causing harassment to the
petitioner. Learned A.A.G. undertakes that official respondents shall act
strictly in accordance with law and would not indulge in any activity contrary
to the law and action, if any, shall be taken strictly in accordance with law.
In the view of above, counsel for
petitioner express his satisfaction and doesn’t press the instant Constitution
Petition more and it is accordingly 'disposed of'.
