The petitioner is aggrieved by an order dated 29.12.2015 whereby his promotion was withdrawn in view of the order passed by Sindh Service Tribunal in Service Appeal No.1208/2015. In the impugned order, it is clearly mentioned that some persons including petitioner who were assigned seniority/promotion benefits individually on the basis of date of appointment as a result of appeals without holding DPC are withdrawn with immediate effect. Admittedly the petitioner is a civil servant. Proper remedy is to file departmental appeal/representation and thereafter the petitioner has to approach Service Tribunal. Keeping in view the bar contained under Article 212 of the Constitution of Islamic Republic of Pakistan, 1973, we cannot entertain this petition. After arguing at some length, learned counsel for the petitioner agrees to file appeal/ representation so that the petitioner may avail proper remedy in accordance with law. Petition is disposed of accordingly alongwith pending application.
