O R D E R

 

MUHAMMAD ALI MAZHAR---J.,All the petitioners are retired employees of the Pakistan Steel Mills; they have approached the management for the payment of their gratuity but for one or the other reasons, their payment could not be made therefore, the petitioners have prayed that the directions be issued to the Respondent Nos. 2 & 3 to ensure the payment of gratuity to the Petitioners. Mr. Muhammad Yamin Zuberi has submitted the comments of Respondent Nos. 2 & 3. However in paragraph-10 it is clearly stated by the respondent Nos. 2 and 3 that they are making genuine efforts to obtain funds from the Federal Government and assures this Court as soon as the funds are made available, ex-employees will be paid their gratuity according to their entitlement.

 

2.         It is a matter of fact that seventy (70) other retired employees of the same Organization had also filed C.P No.D-7004 of 2015 with almost same prayer and the comments were also filed by the respondents. The petition was disposed of vide order dated 4th February, 2016 in terms of paragraph-8 which is reproduced as under:-

 

“8.       Since the claim of the petitioners is admitted in the comments and there is no other opposition and resistance except for the lack of funds, therefore, this petition is disposed of with the directions to the Respondent No. 2 & 3 to ensure the payment of gratuity to all the petitioners in accordance with the law within sixty days without fail and submit the compliance report through M.I.T-II of this Court. Copy of this order may be transmitted to the Chairman Pakistan Steel Mills for compliance”

 

3.         Learned Standing Counsel and Law Officer of Pakistan Steel Mills Mr.Muhammad Yamin Zuberi submitted that this petition may be disposed of in the same terms as earlier Petition C.P No.D-7004 of 2015 was disposed of.

 

4.         By consent, the petition is disposed of in the same terms accordingly. Copy of this order may be transmitted to the Chairman Pakistan Steel Mills for compliance within sixty (60) days without fail and submit compliance report through M.I.T-II. Also transmit the copy of this order to Secretary Finance, Government of Pakistan.
