Muhammad Ali Mazhar, J: The case of the petitioner is that on 17.02.2014 an offer letter was issued to him to join as Associate Professor in the Benazir Bhutto Shaheed University, Liari, Karachi but he was not allowed to join. The controversy involved is that while applying for the post of Associate Professor, the petitioner mentioned in his C.V. that he is also doing Ph.D and result will be announced in the spring, 2013. While taking interview, the Selection Board also awarded him seven marks against Ph.D degree but when he was called upon to produce Ph.D degree, he could not do so because it was not cleared at that relevant time.

 

2.      The Respondents have filed their counter affidavit in which it is stated that offer letter was withdrawn due to misrepresentation of the petitioner as he was not Ph.D. While learned counsel for the petitioner submits that the petitioner was asked to submit the documents vide letter dated 01.02.2014 and the offer letter was issued on 17.02.2014. We have also seen marks awarding sheet which reflects that seven marks were awarded against Ph.D. Learned counsel for the petitioner still claims that even if seven marks are reduced from the total score even then the petitioner has obtained highest marks.

 

3.      The controversial facts raised in the petition requires evidence, therefore, both learned counsel agreed to a modality to settle the dispute that the matter may be referred to the Selection Board to take up in the forthcoming meeting. Learned counsel for the petitioner submits that some timeframe may be mentioned in the order so that credentials and antecedents of the petitioner may be examined by the Selection Board within a reasonable period of time.

 

4.      By consent, this petition is disposed of with the directions to place the matter before the Selection Board within a period of ninety (90) days and Selection Board will examine all the documents which were submitted by the petitioner at the time of filing his application and decide the matter in accordance with law. The Board will also provide opportunity of  hearing to the petitioner.
