            On the last date of hearing, the counsel for the petitioner was asked to satisfy the Court on the point of maintainability as the petitioner has also filed a case before NIRC and a copy of NIRC notice sent to the respondents is available at page 29 of the file. Since the petitioner could not succeed to get an interim order by NIRC, he has filed this petition, which is not maintainable as the matter is also pending before the competent authority. Even otherwise, despite giving a fixed date, counsel for the petitioner is called absent.    The petition is dismissed for non-prosecution.
