Mr. Kashif Nazeer, Advocate has effected appearance, files Vakalatnama on behalf of the Respondent No.4, which is taken on record, and submits that on the undertaking submitted by the petitioner the goods stand released. Counsel for the petitioner has also placed before us a statement dated 05.01.2016 along with an undated letter addressed to the Additional Collector of Customs, DIT, Karachi, giving an undertaking that in case the goods are released after getting them test from an independent laboratory they would abide by the decision of the appropriate PCT on the basis of such report.

Since the parties have settled their disputes amicably, therefore, nothing is left for adjudication, as the goods have already been released after getting them test from an independent laboratory and once the laboratory report is received proper PCT heading would be applied and duties and taxes accordingly would be charged.

Petition stands disposed of in above terms.
