Through this appeal, the appellant has challenged the Judgment and decree passed by this Court in Suit No.164/1996 but today, the respondent No.1 and the appellant’s counsel filed a joint statement. The respondent No.1 is present in Court and on his behalf Mr. Muhammad Wasif Riaz, advocate has filed vakalatnama.

To a question raised by this Court that in the Memo of appeal four other persons have also been arrayed as respondent Nos.2 to 5, the learned Counsel submits that infact judgment and decree has been passed in favour of respondent No.1, which fact is also reflecting from the directions contained in the judgment, however, after resolving the dispute amicably between appellant and respondent No.1, the appellant does not press the appeal against the respondent Nos.2 to 5 and pray that the appeal may be disposed of in terms of the statement submitted today.

In view of the above, the appeal is disposed of in terms of the statement while the appeal against the respondent Nos.2 to 5 is dismissed as withdrawn.
