The petitioner has challenged the suspension order dated 05th October 2015. Learned counsel argued that though the suspension was ordered in the month of October 2015 but neither any show cause notice has been issued so far nor any inquiry has been initiated. He has himself attached one inquiry report to show that on the complaint of Minister Low Cost Housing & Human Resources, Government of Sindh to Chief Minister Sindh on 29.07.2009 regarding poor quality work of New Rest House, Umerkot, the facts findings committee has given their recommendation in paragraph No.6, however, in the preceding paragraph the names of the officers / officials are mentioned including the petitioner at Sr.No.4. The committee recommended that disciplinary action may be initiated against the officers who are involved in the acts, omissions and commissions. Learned counsel also pointed out page 35 which is representation moved by the petitioner against his suspension order. We are sanguine that against the suspension order no appeal lies to the Service Tribunal and the petitioner has to wait for final order and action taken against him. At the same time it is also very important to note that the suspension cannot be spread over for an unlimited period of time and if department wants to initiate any action they should initiate it promptly. Learned A.A.G submits that this petition may be disposed of with the directions to the respondents to decide whether any disciplinary proceedings needs to be initiated against the petitioner or not and if yes than they will start its process within a period of one month. Learned counsel for the petitioner is satisfied to this statement. The petition is disposed of in the above terms alongwith pending application.
