4)       Applicant/accused Maqsood Ahmed Baig son of Allah Ditta Khan seeks protective bail in Crime No.39/2011, registered at P.S. KESC, Karachi under section 39 of the Electricity Act, 2003.

 

          It is inter alia contended that applicants/accused was granted interim pre-arrest bail by this Court in the above mentioned Crime vide order dated 16.06.2011, the same was confirmed on 28.01.2013. Thereafter, applicant/accused was regularly appearing before the trial Court and remained absent as he has sustained firearm injury. It is stated that absence of applicant/accused was neither intentional nor deliberate. Applicant/accused apprehends arrest as NBWs have been issued against him.

 

          In the above circumstances, without touching the merits of the case, protective bail for a period of four days from today is granted to applicant/accused Maqsood Ahmed Baig son of Allah Ditta Khan, subject to his furnishing solvent surety in the sum of Rs.50,000/- and P.R. bond in the like amount to the satisfaction of the Nazir of this Court. Applicant/accused is directed to surrender before the trial Court in the aforesaid crime. He is also directed to join the investigation. Since NBWs have been issued against the applicant/accused, operation of the same is suspended for four days. This order shall cease to have its effect after expiry of three days from today or when the applicant/accused surrenders before the trial Court which one occurs earlier. It is made clear that in case applicant/accused failed to surrender before the trial Court within the aforesaid period his bail bond shall stand forfeited.  

 

          Application is accordingly disposed of.
