3) Applicant/accused Syed Khalid Zafar Hashmi son of Syed Zafarul Hassan Hashmi seeks protective bail in Crime No.36/2015, registered at P.S. ACE West Zone-II, Karachi under sections 420, 468, 471, 34 PPC read with Section 5(2) of the Prevention of Corruption Act-II, 1947.

It is inter alia contended that applicants/accused Syed Khalid Zafar Hashmi son of Syed Zafarul Hassan Hashmi is ready to surrender before the trial Court but apprehends arrest with ulterior motive. Serious mala fides have been alleged against the ACE authorities.

Without touching the merits of the case, protective bail for a period of three days from today is granted to applicant/accused Syed Khalid Zafar Hashmi son of Syed Zafarul Hassan Hashmi, subject to his furnishing solvent surety in the sum of Rs.50,000/- and P.R. bond in the like amount to the satisfaction of the Nazir of this Court. Applicant/accused is directed to surrender before the trial Court in the aforesaid crime. He is also directed to join the investigation. This order shall cease to have its effect after expiry of three days from today or when the applicant/accused surrenders before the trial Court which one occurs earlier. It is made clear that in case applicant/accused failed to surrender before the trial Court within the aforesaid period his bail bond shall stand forfeited.

Application is accordingly disposed of.
