3. Through the instant petition, petitioner Abdul Karim Nosherwani seeks protective bail as he has received notice Annexure “A” from NAB Baluchistan that he has accumulated huge assets/properties through unjustified sources of income by misusing authority when he was Minister for Excise & Taxation, Government of Baluchistan. Counsel for the petitioner submits that NAB has issued notice to petitioner with malafide intention and petitioner is prepared to surrender before learned High Court Baluchistan for seeking relief available to him under the law. Petitioner apprehends arrest with ulterior motive before his surrender to concerned Court.
Mr. Noor Muhammad Dayo, Special Prosecutor NAB waives notice and recorded no objection.
Without touching the merits of the case, protective bail for the period of Seven days from today is granted to the petitioner Abdul Karim Nosherwani, subject to his furnishing solvent surety in the sum of Rs.Rs.500,000/- (Rupees Five Lac) and P.R bond in the like amount to the satisfaction of the Nazir of this Court. Petitioner is directed to surrender before the concerned Court in the aforesaid period. This order shall cease to have effect after expiry of Seven days or whenever the petitioner surrenders before the concerned Court. In case the petitioner fails to surrender before the concerned Court his bail bonds shall stand forfeited. He is further directed to cooperate with investigating agency in the aforesaid period.
Petition is disposed of in the aforesaid terms.
