& others …………….. Respondents
1. For order on Misc. No.29881/2016
2. For order on Office Objection No.1
3. For order on Misc. No.29882/2016
4. For hearing of Main Case.
16th November, 2016.
Mr. Abdul Samad Memon Advocate for the Petitioner.
Mr. Abdul Jaleel Zubedi A.A.G.
-------------------------
The petitioner has approached this court for the implementation of the order dated 06.05.2016 passed by the Additional Inspector General of Police, Karachi Range on behalf of Dr. Ghulam Sarwar Jamali, DIGP/Administration in which the name of the petitioner is at serial No.6, who was transferred from Security-I, Karachi to South Zone, Karachi.
2. Learned counsel submits that despite this clear order, respondent No.3 is not relieving the petitioner. This court has nothing to do with the transfer and posting of the Civil Servants in terms of Article 212 of the Constitution, 1973. Even otherwise in this case, the proper and appropriate remedy was to move application to the competent authority, if there is some delay in the implementation of the transfer order.
3. Learned A.A.G. present in court waives notice of this petition and copy has been supplied to him. He is also of the view that this petition is not maintainable, which is dismissed. However, the petitioner may approach to the competent authority and file proper application/representation, if he is aggrieved on the ground that he has not been relieved.
