Muhammad Ali Mazhar, J:The petitioner is aggrieved by the seniority granted to the respondent No.5. In this regard he has also preferred an Appeal to the Managing Director KW&SB on 19-04-2016 which has not been decided. The comments have been filed on behalf of respondent Nos. 3 & 4 in which the filing of Appeal has been admitted in paragraph-11. It is further stated that the Appeal of the respondent / petitioner will be forwarded for deciding seniority to the Local Government Department Government of Sindh. Despite notices nobody is present on behalf of respondent No.5 nor the comments have been filed.

            Learned counsel for the KW&SB as well as learned AAG both proposed that some directions may be issued to the respondent Nos. 2 & 4 to process the Appeal and decide the same within reasonable period of time which proposal has been accepted by the learned counsel for the petitioner.

            In view of the above, this petition is disposed of with directions to respondent Nos. 2 and 4 to decide the pending Appeal of the petitioner after providing ample opportunity to him as well as respondent No.5. This exercise will be completed within a month. Compliance report be submitted to this court through MIT-II.
