MUHAMMAD ALI MAZHAR, J:- The petitioner has approached this Court for direction against the respondent No.2 to consider him in the DPC for promotion. Learned counsel for the petitioner submits that during pendency of this petition, one Soofi Abdul Hafeez filed Appeal No. 1664 of 2015 in Sindh Services Tribunal where office order dated 14.07.2015 issued by the respondent No.2 was set aside vide order dated 30.05.2016, against which Civil Petition for leave to Appeal No. K-573 of 2016 has been preferred in the Honourable Supreme Court by the petitioner. Learned counsel submits that the matter pending in the Honourable apex Court is somewhat identical and similar to the issues involved in this case and since the petitioner has already approached the Hon’ble apex Court, therefore, he does not want to proceed this petition, on instructions of the petitioner.

This statement has been confirmed by learned counsel for the respondent No. 4 and learned AAG.

In view of this position, the instant petition is disposed of accordingly.
